Deed signing & witness page

England and Wales has no US-style notary for ordinary deeds. A witnessed signature block does the job. Fill in the boxes, print, sign.

Deed signing and witness page

A deed in England and Wales must make clear it is meant to be a deed, be signed the way the law requires, and be delivered (Law of Property (Miscellaneous Provisions) Act 1989, s.1). Attach the block you need to the end of the document. The document itself should say it is executed as a deed.

Notes on the witness

  • An adult who is not a party to the deed and has no interest in it.
  • Choose someone independent. HM Land Registry advises against a family member or partner.
  • The witness must be physically present and see the signature. Video witnessing is not accepted for deeds sent to HM Land Registry.
  • Where a document has its own prescribed signature wording (for example a transfer of registered land), use that instead.
  • A deed takes effect when delivered. Date it only once everyone has signed. If a solicitor is involved, let them date and deliver it.
